Terms & conditions

These Terms & Conditions ("Terms") are an agreement between you and TheAuction.ng ("TheAuction.ng", "we", "us"). By creating an account or using https://auction.betacheckhub.info (the "Platform"), you agree to these Terms. If you do not agree, please do not use the Platform.

1. What we are

TheAuction.ng is an online marketplace that connects buyers and sellers. We provide the venue and tools for listing, bidding, buying, and communicating. We are not the seller, buyer, or an agent of either party. We do not take ownership of items, and we do not currently process or hold payments — buyers and sellers transact directly with each other. The contract of sale is solely between the buyer and the seller.

2. Eligibility & accounts

• You must be at least 18 years old and legally able to enter into contracts.
• You must provide accurate information and keep your account details up to date.
• You are responsible for keeping your password secure and for all activity under your account.
• One person or business may not maintain accounts to evade suspension or manipulate ratings or bids.

3. Buyers

• Bids are binding. Placing a bid is a firm, irrevocable offer to buy the item at that price if you win. Do not bid unless you intend to complete the purchase.
• Buy-now is binding. Clicking Buy Now creates an order you are committed to.
• You agree to pay the agreed price and any delivery cost, and to communicate promptly and in good faith.
• You are responsible for checking a seller's rating and the item description before committing.

4. Sellers

• You must have the legal right to sell each item and must describe it honestly and accurately.
• You must not list prohibited items.
• Once your auction ends with a winning bid that meets any reserve, or a buyer uses Buy Now, you are committed to sell the item to that buyer at that price.
• You are responsible for fulfilling orders, arranging delivery as agreed, and handling your own tax and legal obligations.
• You may not manipulate your own auctions (for example, bidding on your own items or using other accounts to inflate prices).

5. Auctions & reserve prices

Each auction has a start price, bid increment, duration, and optional hidden reserve. When the timer ends, the highest bid that meets the reserve wins and an order is created. If no bid meets the reserve, the item does not sell. We may settle ended auctions automatically.

6. Payments & delivery

Payment methods (bank transfer, mobile money, card, or pay-on-delivery) are arranged directly between buyer and seller. TheAuction.ng does not hold funds and is not responsible for payment between the parties. Delivery, collection, and any associated risk and cost are agreed between buyer and seller. We strongly encourage the safety practices in our Trust & Safety guide.

7. Reviews & content

• Reviews must be honest and based on a genuine transaction. Fake, retaliatory, or abusive reviews are prohibited.
• You retain ownership of content you post (listings, photos, comments) but grant us a licence to display and promote it on the Platform.
• You must not post unlawful, misleading, offensive, or infringing content.

8. Prohibited conduct

You agree not to:

• Defraud, harass, or mislead other users.
• List prohibited or illegal items, or infringe others' rights.
• Manipulate bids, ratings, or search results.
• Attempt to disrupt, hack, scrape, or overload the Platform.
• Use the Platform to advertise or divert users to competing or fraudulent services.

9. Moderation & suspension

We may review, remove, or refuse any listing, and we may verify, warn, suspend, or terminate any account that breaches these Terms or puts other users at risk — with or without notice where necessary to protect the community.

10. Disputes between users

If a transaction goes wrong, you should first try to resolve it directly with the other party. You may open a dispute from the order page; our team may review it and reach a resolution (such as completing or cancelling the order). Our decision on platform matters is final, but it does not replace your legal rights against the other party.

11. Disclaimers & limitation of liability

The Platform is provided "as is". Because we are only a venue, we do not guarantee the quality, safety, legality, or delivery of any item, or the truth of any listing or user. To the fullest extent permitted by law, TheAuction.ng is not liable for losses arising from transactions between users, from user content, or from your use of the Platform. Nothing in these Terms excludes liability that cannot lawfully be excluded.

12. Privacy

Our Privacy Policy explains how we handle your personal data. By using the Platform you consent to that handling.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here with a new effective date, and continued use of the Platform means you accept the changes.

14. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Nigeria have jurisdiction over any dispute, without prejudice to any mandatory consumer protections that apply where you live.
